Definitions

Guitar Pedals For You: based in Sprundel, Netherlands, Chamber of Commerce number 84639113.

Customer: any natural person or legal entity entering into an agreement with Guitar Pedals For You.

Consumer: a customer who is a natural person acting outside their business or professional activity.

Agreement: any arrangement between Guitar Pedals For You and the customer regarding the delivery of products or services.

Applicability

These terms and conditions apply to all offers, agreements, orders, deliveries and other transactions, regardless of the platform or communication channel through which they are concluded (including email, Marktplaats, Reverb, etc.).

Deviations from these terms are only valid if agreed upon in writing.

The applicability of other general terms and conditions is explicitly excluded.

Prices

All prices are stated in euros and include VAT unless stated otherwise.

Price increases occur rarely. If they do occur, customers will be informed by email and consumers have the right to cancel the agreement.

Payment

Payment must be made prior to delivery unless otherwise agreed.

In case of late payment, the customer will owe the statutory interest as determined by the Dutch government.

Extrajudicial collection costs will be calculated in accordance with the Dutch Decree on Compensation for Extrajudicial Collection Costs.

In case of default, Guitar Pedals For You is entitled to suspend its obligations and immediately claim all outstanding payments.

Delivery

Delivery takes place while supplies last and to the address provided by the customer.

Delivery times are indicative. If delivery is delayed, Guitar Pedals For You will be granted an additional period of 14 days to complete delivery.

If the packaging is damaged upon delivery, the customer must immediately have this noted by the carrier.

Hidden transport damage must be reported within 2 working days after discovery.

Right of Withdrawal

Consumers have the right to withdraw from the purchase within 14 days.

Returned items must be sent back within 14 days after the withdrawal notification.

Return shipping costs are borne by the consumer.

If the conditions are met, all payments received, including the original shipping costs, will be refunded within 14 days.

Warranty

A warranty period of 30 days applies to defects caused by manufacturing or material faults.

The warranty does not apply in cases of damage caused by improper use, accidents, modifications or normal wear and tear.

Exchanges

Items may be exchanged within 14 days, provided that:

Returned items must be unused and in the same condition as received.

Discounted or modified products are excluded from exchanges.

PedalSwap (Trade-ins)

Pedals traded in through PedalSwap cannot be returned or exchanged back.

The traded item can only be traded again for the standard PedalSwap value, which may be lower than the previously assigned value.

The right of withdrawal does not apply to trade-in transactions.

Liability

Guitar Pedals For You is only liable for direct damages caused by intentional misconduct or gross negligence.

Liability is limited to the invoice amount or the amount covered by the applicable insurance.

Indirect damages will not be compensated.

Complaints

Complaints must be submitted in writing within 14 days after discovery.

The customer must be able to demonstrate that the complaint relates to an agreement with Guitar Pedals For You.

Force Majeure

Guitar Pedals For You is not liable in cases of force majeure (including power outages, natural disasters, strikes or government measures).

If the force majeure situation lasts longer than 30 days, both parties have the right to terminate the agreement.

Final Provisions

Changes to these terms and conditions will be communicated in writing or electronically.

Customers who conduct business with Guitar Pedals For You through any channel accept these terms and conditions.

All agreements are governed by Dutch law.

Disputes will be submitted to the competent court in the district where Guitar Pedals For You is established.
